Overview
This Content Rights Policy explains the rules and guidelines for content you create, upload, and distribute through Punchable. This policy is part of our Terms of Service.
1. Your Content Rights
1.1 You Own Your Content
You retain full ownership of all content you create in Punchable, including: Business name, logo, and branding; Loyalty program names and descriptions; Coupon titles and promotional text; Terms and conditions you write; Images you upload; Pass designs you create. We (Punchable) do not claim ownership of your content.
1.2 License You Grant to Punchable
By creating content in Punchable, you grant us a limited, non-exclusive, royalty-free license to:
What we can do: Store your content on our servers; Display your content in digital wallet passes; Distribute passes to your customers; Make backup copies for disaster recovery; Process content to provide the Service; Display content in your account dashboard.
What we cannot do: Use your content for our own marketing (without permission); Sell or license your content to others; Claim ownership of your content; Use your content after you delete it (except in backups for 90 days).
This license automatically terminates when you delete content, is limited to providing the Punchable service, does not transfer ownership to us, and allows you to use your content elsewhere.
1.3 Content Deletion
You can delete your content at any time: Delete individual loyalty programs or coupons; Delete uploaded images; Delete your entire account. Deletion timeline: Immediate removal from active systems (within 48 hours); Removal from backups within 90 days; Passes already in customer wallets become static (no longer update).
2. Content You Upload
2.1 Types of Content
You may upload: Business Information (business name, address, phone, website URL, social media handles); Visual Content (logo, product images, background images, icons); Text Content (loyalty program names, descriptions, coupon details, terms and conditions, email templates); Program Configuration (reward structures, point values, discount amounts, expiration dates, redemption rules).
2.2 Content Requirements
All content you upload must: Be Accurate (truthfully represent your business, accurate contact and pricing info; no false or misleading claims); Be Lawful (comply with applicable laws, meet consumer protection standards; no illegal products); Be Original or Licensed (content you created or have rights to use; no stolen or copied content); Be Appropriate (professional and business-appropriate; no offensive, explicit, hate speech, or dangerous content).
3. Intellectual Property Guidelines
You represent and warrant that: You own or have rights to all content you upload; You have authority to use your business name and logo; Your content does not infringe anyone else's rights; You have all necessary licenses and permissions; You have authority to make promotional offers; Your terms and conditions are legally valid.
Third-Party Content: If you use stock images, fonts, or icons, you must purchase proper licenses (commercial use), follow license restrictions, and keep proof of purchase. Do not use "personal use only" content for business.
Brand Name and Trademark Usage: Use your own brands freely. For other companies' brands, use with extreme caution—only if you have explicit permission or legally allowed (e.g., authorized reseller). Do not use logos without authorization or imply endorsement you don't have.
Punchable Branding: You may say "Powered by Punchable" or mention you use Punchable. You may NOT use Punchable logo without permission, imply official partnership, use "Punchable" in your business name, or register domains with "Punchable."
4. Prohibited Content
Illegal Content: No illegal drugs, weapons, counterfeit goods, pyramid schemes, unlicensed gambling, consumer protection violations, false advertising, or deceptive trade practices.
Harmful Content: No hate speech, discrimination, harassment, sexually explicit content, violence, promotion of self-harm, content that exploits children, or dangerous activities.
Misleading Content: No false claims, fake reviews, misleading pricing, bait-and-switch, unrealistic promises, or hidden fees.
Infringing Content: No copied text, unlicensed images, trademark infringement, counterfeit goods, or violation of copyright, trade secrets, or right of publicity.
Spam Content: No duplicate programs to spam customers, excessive email frequency, fake urgency, false scarcity, or misleading discount claims.
5. Brand and Trademark Usage
Use your own registered trademarks freely (® if registered, ™ if unregistered). When using others' trademarks: Only if authorized reseller with written agreement; Or nominative fair use (e.g., "We repair Samsung phones") if truthful and not implying endorsement. When you may NOT: Without authorization, to imply false endorsement, to confuse consumers, or for counterfeit goods. If in doubt: Get written permission or don't use it.
6. Copyright Infringement (DMCA)
Punchable complies with the Digital Millennium Copyright Act (DMCA).
If your copyright is infringed: Send DMCA notice to dmca@punchable.app. Your notice must include: Your contact information; Identification of the copyrighted work; Identification of infringing material; Statement of good faith belief; Statement of accuracy under penalty of perjury; Your signature.
DMCA Counter-Notice: If your content was removed and you believe it was a mistake, send counter-notice to dmca@punchable.app. We will forward to complainant; if no lawsuit within 10-14 business days, we may restore your content.
Repeat Infringer Policy: First offense: Warning + content removal. Second offense: 7-30 day suspension. Third offense: Permanent termination.

7. User Reporting
Report violations to abuse@punchable.app with: Your contact information; Description of violation; Link to content or business name; Why you believe it violates policy; Supporting evidence. We review within 24-48 hours. Knowingly filing false reports may result in account suspension.
8. Consequences of Violations
First Violation (Minor): Warning email, required to correct within 48 hours.
Serious Violation: Content removed immediately, 7-30 day suspension, required to provide proof of rights.
Severe Violation: Immediate termination, all content removed, no refund, reported to authorities if illegal, permanent ban.
Appeal: Email appeals@punchable.app. We review within 5-7 business days. Appeal decisions are final.
9. Content Monitoring
We are not obligated to monitor content but reserve the right to review, remove violating content, investigate reports, and use automated tools. You are solely responsible for content you create. We are not liable for content you create.
10. Content Backup and Storage
You should regularly export and backup your data. We provide Settings → Export Data. We maintain backups for disaster recovery; they are not intended for individual data recovery, may not be complete, are deleted after 90 days, and are not directly accessible. Do not rely on our backups.
11. Updates to This Policy
We may update this policy. Material changes: 30 days advance notice via email. Minor clarifications: Update without advance notice. Continued use constitutes acceptance.
